    <LegalStatus>The ‘Government of Ireland Act 1920’ Section 8(3) B provided delegated powers to establish Executive Departments by Act of Parliament of Northern Ireland. The ‘Ministries of Northern Ireland Act 1921’ established the Ministry of Agriculture for Northern Ireland which was subsequently renamed the Department of Agriculture for Northern Ireland through the ‘Northern Ireland Constitution Act 1973’ Chapter 36 Section 7(5). The ‘Northern Ireland Constitution (Devolution) Order 1973’ provided for the commencement date for the Department of 1st January 1974.  The Department of Agriculture for Northern Ireland was renamed Department of Agriculture and Rural Development by the ‘Department (Northern Ireland) Order 1999.’ 
The ‘Government of Ireland Act 1920’ and ‘Ministries of Northern Ireland Act 1921’ have been repealed by the ‘Northern Ireland Act 1998 Chapter 47’ and ‘Department (Northern Ireland) Order 1999’ respectively. 
The Department of Agriculture and Rural Development is the statutory drainage and flood defence authority for Northern Ireland. Arterial drainage powers were transferred from the County Councils under the ‘Drainage Act (Northern Ireland) 1947’ Chapter 9 to the then Ministry of Agriculture. As a result of reorganisation of local government in Northern Ireland the ‘Drainage (Northern Ireland) Order 1973’ revised the law relating to drainage in Northern Ireland and transferred powers in relation to urban drainage and maintenance from local authorities, empowered under the ‘Urban Drainage Act (Northern Ireland) 1957’, to the Ministry of Agriculture. The ‘Drainage (Northern Ireland) Order 1973’ repeals the ‘Urban Drainage Act (Northern Ireland) 1957’ and the ‘Drainage Act 1947’ and provides the Department of Agriculture and Rural Development with discretionary powers to maintain watercourses and sea defences which have been designated by the Drainage Council for Northern Ireland, construct and maintain drainage and flood defence structures and administer enforcement procedures to protect the drainage function of all watercourses. 
The ‘Water Environment (Floods Directive) Regulations (Northern Ireland) 2009’ establishes the Department of Agriculture and Rural Development as the competent authority for the purposes of the implementation of the Floods Directive in Northern Ireland (see S.R. 2009 No. 376 article 3). Rivers Agency, an Executive Agency within the Department of Agriculture and Rural Development undertakes these functions on behalf of the Department.</LegalStatus>
